What is the detailed process for E3 Visa?

Nationals of Australia can only apply for E3 visa. People who want to apply for E3 visa should come to the US solely to perform the services in a specialty employment. This specialty employment needs practical and theoretical application of a body of knowledge in specialized field and at least the person should hold bachelor’s degree or any it’s equivalent, as a minimum base for entry into the occupation in US.

Here are the requirements to qualify for E3 Visa:

How to apply for E-3 Visa when I am in United States?

Here are the supporting documents needed for change of address:

  • A labor condition application (LCA)
  • Academic credentials that demonstrate you to qualify for the petition

How to apply for E-3 Visa with U.S. Embassy or Consulate?

Once you receive all the necessary documents, you have to apply for E-3 visa with U.S. consulate abroad. First time applicants are required to apply for the visa in Australia because the other Consulates may not be aware of the adjudication of E-3 visa. What is the period of stay or extension of stay?

  • Initial period of stay is 2 years
  • Extension of stay – Extension will be given for up to 2 years per each extension. There is no specified figure for extension, but with some exceptions.
 

What about the spouse and family of E-3 visa holders?

Same E-3 grouping is applicable for partner and unmarried children who are under 21 years. Among all your dependents, your spouse is eligible for work authorization. Spouses who want to apply to get work authorization; it is required to file a form I-765, which is the Application for Employment Authorization.

Does E-3 come in the category of dual intent visas?

Unlike H-1Bs and L-1s, E-3s are not dual intent visas. However, they don’t need any foreign residence requirement. Also, there is a case law that states the expression of wish to permanently stay in the US as conflicting to intending to stay even if lawfully not allowed, is allowable on an E visa.
